Fifty Winchester .22 calibre cartridges with ‘H’ head stamps, loose in black plastic tray with model paints and brushes in cardboard box located under window of bedroom 4 in Ivan’s house. 1. The Winchester cartridges in both groups are consistent with the Winchester cartridges found at the Clarke crime scene in the forest.

  Four Winchester .22 calibre cartridge cases found at the Wombeyan Caves Road property owned by Walter and Richard Milat. 1. All four cases were consistent with having been discharged from a rifle to which the Ruger bolt assembly located in the wall cavity in Ivan’s house had been fitted.

  Three Winchester and one PMC .22 calibre cartridge cases recovered in shooting mound at Buxton property previously owned by Alex Milat. 1. All four cases were consistent with having been discharged from a rifle to which the Ruger bolt assembly located in the wall cavity in Ivan’s house had been fitted.

  One Winchester .22 cartridge case with Ruger impression located in plastic bag with .45 and .32 calibre ammunition, inside cardboard box on bed in bedroom 4 at Ivan’s house. 1. The cartridge case is consistent with having been fired by a Ruger 10/22 to which the Ruger bolt assembly found in the cavity of the wall at Ivan’s house had been fitted.

  Two pieces of shirt with Ruger parts in white plastic bag located in wall cavity in Ivan’s house. 1. One piece of cloth was the shoulder section of a shirt comparable in size and shape to one of the pieces of material in Walters’ mouth gag.

  Silver-coloured silencer located in box on shelf in garage of Ivan’s house. 1. At least one rifle used in the killing of the backpackers was fitted with a silencer when seven or more bullets were fired.

  2. This silencer was tested but blew out baffles inside silencer (could have fitted a modified Ruger model 10/22 rifle barrel).

  3. Noel Wild, a workmate of Ivan, said he saw Ivan with a silencer fitted on a .22 calibre rifle.

  4. Johanna Breitkopf, who worked with Ivan, and Walter Milat said that Ivan discussed silencers.

  5. Rifles owned by Ivan other than the Ruger had threaded barrels to suit silencers.

  Ivan carried a knife in his car. 1. Victims Everist, Gibson, Schmidl, Habschied and Walters had stab wounds. Clarke and some others had cuts to their clothing.

  2. A camouflage-handled Bowie knife in a brown leather pouch was found inside a ‘Triple M’ bag in bedroom 4 at the Eagle Vale house.

  3. Ivan said he carried the camouflage knife in his work bag.

  4. Johanna Breitkopf, who worked with Ivan, saw the knife on the floor of Ivan’s car.

  5. Anthony Sara, a workmate of Ivan’s, identified the knife as being carried by Ivan.

  6. Craig Gandy, work associate of Ivan, identified the camouflage-coloured knife as being very similar to the one carried by Ivan.

  Five lengths of sash cord in green striped pillowcase and single length of sash cord located on a shelf in the garage at Ivan’s house. 1. The pillowcase and one of the cords have blood on them consistent with blood of a child of Mr and Mrs Clarke.

  2. Cords comparable with sash cord in ‘leash device’ at Habschied and Neugebauer crime scene.

  3. Karen Milat identified the sash cords as the type used by Ivan to tie minibike onto trailer.

  4. Karen Milat identified the pillowcase as belonging to Ivan’s mother.

  5. Ivan said he used this type of sash cord.

  E.W. Groening bag containing a quantity of rags located in garage of Ivan’s house. 1. The rags were similar to Walters’ gag and other rags recovered in the forest near crime scenes.

  2. Identified as being supplied to the Central Asphalt Depot.

  3. Ivan admitted that he obtained the bag of ‘jumbo’ rags from work.

  Olympus ‘Trip S’ 35 mm camera, serial number 1259700, located in kitchen drawer at Ivan’s house. 1. Identified as same type of camera owned by Clarke.

  2. The serial number identified the camera as being manufactured in Malaysia and shipped to UK, where it was received on 29 June 1990. Clarke left UK for Australia in September 1991.

  1989 English 20-pence coin located in console of Ivan’s red Holden Jackaroo number QBY-388. 1. Clarke and Walters came from UK after 1989.

  2. Ivan had no international travel movements during relevant period.

  Two photographs of Chalinder Hughes, Ivan’s girlfriend, in green and white Benetton top, located in album and photograph wallets on the coffee table in the family room at Ivan’s house. 1. Mr and Mrs Clarke say that Caroline had a green and white Benetton top before leaving for Australia.

  2. This type of top was sold in Europe before 1990. There was a Benetton shop near where Caroline had worked in Surrey, England.

  3. A Benetton representative said that that all photographs of the Benetton top on Chalinder Hughes (Ivan’s girlfriend) and Clarke appear to be of the genuine item and the same size, style and colour.

  Piece of cloth (shirt) wrapped around a rifle bolt in the padlocked grey locker at the Guildford house of Ivan’s mother, Margaret. 1. Professor Pailthorpe said the cloth was consistent with part of the back panel of a shirt and appeared to have been cut and torn.

  2. The piece of cloth was comparable in size and shape with one of the pieces of material in the Walters’ mouth gag and found to be similar.

  3. Ivan said the grey locker and its contents were his.

  Blue and lilac Caribee ‘Blaze’ sleeping bag located in cupboard inside garden shed at Richard Milat’s Hill Top property. 1. Ivan admitted the sleeping bag belonged to Walters.

  2. Found near a green and orange tent and green tent fly, which Ivan admitted belonged to him.

  Blue and orange Ultimate sleeping bag in grey and red sleeping bag cover, Karrimat bed roll with Karrimor strap marks, blue tent with strip of computer label, and blue bag containing poles and accessories located in cupboard inside garden shed at Richard Milat’s Hill Top property. 1. The blue tent was given to Clarke by Stephen Wright during their trip to Tasmania. Wright repaired a hole he had made in the tent with a strip from a computer label.

  2. Wright also identified an elasticised camping clothes line in the blue bag as belonging to Clarke.

  3. Ivan admitted the sleeping bag belonged to Clarke.

  4. Ivan claimed the tent and tent fly belonged to him.

  Green and orange tent in brown bag, green tent fly also in brown bag, tent supports and tent poles in two brown bags; hessian bag with tent pegs and ropes, and white plastic bag containing rags and other material located in cupboard in garden shed at Richard Milat’s Hill Top property. 1. Property identified by Karen Milat as belonging to Ivan.

  2. Karen Milat identified the tent as being the same tent shown in a photograph with Ivan. The green tent fly only is depicted in the photograph.

  3. Carolynne Milat identified the tent in the photograph as the tent Ivan used during a camping trip at the Wombeyan Caves Road property.

  4. A tent and accessories identified as belonging to Ivan were found on or near the same shelf where the camping equipment he admitted as belonging to Clarke and Walters was found.

  5. Ivan said the tent and tent fly belonged to him.

  Paul Thomas Onions: Attempted abduction and shooting January 1990

  Items located and claims against Ivan Comments

  Small men’s-size, long-sleeved blue cotton Next-brand shirt in red plastic box located on floor of garage at Guildford house of Ivan’s mother, Margaret. 1. Onions identified the shirt as being identical to his shirt, which was in his backpack when taken by Ivan, except for some red stitching.

  2. Anthony O’Connor of Next, England, identified photographs of a shirt being worn by Onions and the shirt found on the garage bench as being Next shirts of the same design and style.

/>   3. The shirt was manufactured for Next and available for sale from Next stores in the UK during their 1986 season.

  4. There were no overseas outlets for the sale of that shirt at that time.

  5. Onions wore a small men’s-size shirt, the same size at that found in the garage at Ivan’s mother’s house.

  6. Found in the same red plastic box on the floor of the garage was a blue-checked short-sleeved shirt.

  7. Karen Milat identified this shirt as belonging to Ivan.

  8. Ivan said he had a shirt similar to the blue-checked shirt.

  The accused had a revolver that matched the description of the one seen by Onions. Revolver 1: Colt .45 ACP revolver. 1. Grip plates suitable for Colt ‘New Service’ .45 ACP revolver and two PMC .45 calibre cartridges—one fired—located in left-hand drawer of dressing table in bedroom 4 of Ivan’s house.

  2. Quantity of .45 PMC and Winchester cartridges in a plastic bag with .32 calibre cartridges and a single fired Winchester .22 calibre cartridge case in a cardboard box, on the bed in bedroom 4 of Ivan’s house.

  3. Quantity of .45 PMC, Winchester and Norma cartridges found in plastic bag in milk crate on shelf in garage at Ivan’s house.

  4. Twelve cartridge adaptors (full moon clips) found in console of Ivan’s red Holden Jackaroo number QBY-388.

  5. All items suitable for use in a Colt ‘New Service’ .45 ACP revolver.

  6. Photographs found at Ivan’s house depict Ivan’s Harley Davidson motorcycle number YYG-37 and revolver, which appears consistent with a Colt ‘New Service’ .45 ACP revolver loaded with copper-tipped cartridges. Written on the back of one photo are the words ‘17 Colt 45 ACP’.

  7. Also depicted in the photograph is Ivan’s Franchi 12-gauge self-loading shotgun found in the alcove at Walter Milat’s Hill Top house; camouflage-coloured 7.62 × 39 mm SKK rifle consisting of:

  • SKK barrel and receiver, serial number 8813143, with telescopic sight, found in the alcove

  • gun magazine, one of two SKK magazines owned by the accused, found inside Schmidl’s High Sierra day pack, which was in the alcove

  • wooden rifle stock found in the alcove

  • bayonet, found in the left-hand drawer of the dressing table in bedroom 4 of Ivan’s house.

  8. The .45 calibre cartridges are the same brands and type as 24 .45 calibre cartridges in four cartridge adaptors found inside Schmidl’s High Sierra day pack in the alcove.

  9. The .45 calibre cartridges are copper-tipped, and Onions said Ivan used copper-tipped bullets in the revolver.

  10. The cartridge adaptors are the same style and type of manufacture as the four cartridge adaptors in the High Sierra day pack.

  11. Detective Senior Constable Roach, Ballistics, said the barrel length of the Colt .45 ACP revolvers range from 4 to 71½ inches.

  12. Onions said Ivan had a revolver with a barrel of 4–6 inches.

  The accused had a revolver that matched the description of the one seen by Onions. Revolver 2: .38 calibre revolver. 1. Four Dominion ‘Smith and Wesson’ .38 calibre fired cartridge cases located in left-hand drawer of dressing table in bedroom 4 at Ivan’s house.

  2. Box of Dominion ‘Smith and Wesson’ .38 calibre cartridges with Canon ‘Prima’ instruction book and model parts in cardboard box located on bed in bedroom 4 at Ivan’s house.

  3. Dominion cartridges suitable for a .38 calibre revolver.

  4. Anthony Sara, a workmate of Ivan, said Ivan had told him he had a .38 six-shot revolver.

  5. The .38 calibre cartridges are copper-tipped and Onions says the accused used copper-tipped bullets in the revolver.

  The accused carried a handgun in his car. 1. Browning, manufactured by Fabrique Nationale, 7.65 mm (.32 calibre) pistol, engraved, with nine cartridges, pouch and magazine with five cartridges (Winchester and Sellier & Bellot), with plastic bag, found under washing machine in laundry in Ivan’s house.

  2. Detective Senior Constable Roach, Ballistics, said the engraving on the pistol is by percussion engraver, as is engraving on .44 calibre black powder revolver found in alcove at Walter’s property.

  3. Karen Milat identified pistol and pouch as belonging to Ivan.

  4. Karen Milat said Ivan used to carry this pistol in his sock and under the driver’s seat of his car.

  5. Ivan disputed that he carried his pistol in his sock and under the driver’s seat of his car.

  6. Walter Milat said Ivan had a pistol like the one recovered under the washing machine.

  7. Ivan said the pistol was his, but he last saw it at Blackett in early 1987 when Karen Milat left.

  8. Quantity of .32 (Winchester and Sellier & Bellot) cartridges found in plastic bag, with .45 calibre cartridges and a single fired Winchester .22 calibre cartridge case, inside cardboard box on bed in bedroom 4 at Ivan’s house.

  9. The .32 calibre cartridges are suitable for use in the pistol.

  10. A camouflage-coloured wooden box with .44 calibre black powder revolver marked ‘Texas’ with contents found in alcove at Walter Milat’s property.

  11. Detective Senior Constable Roach, Ballistics, said the engraving on the revolver is consistent with the type of engraving on the pistol found at Ivan’s place.

  12. Karen Milat identified the revolver and the wooden box as belonging to Ivan.

  13. Karen Milat said Ivan would put the box with revolver in it under the back seat of the car when they went on trips.

  14. Ivan denied putting the gun under the back seat of his car.

  15. Ivan admitted that he owned the revolver.

  The accused had a bag of dirty ropes similar to that seen and described by Onions. 1. Five lengths of sash cord in a green striped pillowcase were found on a shelf in the garage at Ivan’s house.

  2. Karen Milat identified the sash cords as the type used by Ivan to tie a minibike onto trailer.

  3. Ivan said he used the type of sash cord found.

  4. Karen Milat identified the pillowcase as belonging to Ivan’s mother.

  1989 English 20-pence coin found in console of Ivan’s red Holden Jackaroo number QBY-388. 1. Onions left England about 8 December 1989.

  2. Ivan had no international travel movements during relevant period.

  When Ivan picked up Onions he called himself Bill. 1. Ivan used the name William ‘Bill’ Milat when he worked at Sweeping Services in late 1988.

  2. New Zealand postcard addressed to ‘Bill’ from Graham ‘Jock’ Pittaway, postmarked 22 April 1992, found on bedside table in bedroom 3 of Ivan’s house.

  3. Tax declaration form in the name of William Milat from the RTA.

  Ivan’s vehicle matches the description given by Onions. 1. A number of photographs depict a camping trip at the Wombeyan Caves Road property during Easter 1991. They include photographs of Ivan’s silver Nissan Patrol, number OPO-172, with sheepskin seat covers.

  2. Onions’ description of Ivan’s vehicle describes lambswool seat covers on the front seats.
